| M37 deadline approaches for Oregonians |

Tick, tick, tick. The deadline to file a Measure 37 claim is just around the corner... for some people. Oregonians approved the land use compensation law Dec. 2, 2004. The text of the law deems certain rules apply only if a claim regarding land use regulations enacted before 2004 is filed within two years of the Measure's passage. "We have received four or five measure 37 claims in the last seven days," said Crook County counsel Dave Gordon. The number of claims is substantial as the county has received approximately 40 total Measure 37 claims. "In the last two months we have maybe received four (claims)," Gordon said. "We have seen an uptick in people that are filing and I suspect we'll see more of that this week." Because Dec. 2 falls on a Saturday, many agencies are bumping the deadline to Monday, Dec. 4, while others are considering Friday, Dec. 1 the last date to file under those rules. "The county takes the position that there is a two year period you can file without previously having been rejected for an application," Gordon said. Claimants may still file after the Dec. 2, 2006 end date. However, those claims will require more paperwork and likely more waiting, for the claimant. As of now, after Dec. 4 in Crook County, the two year Measure 37 filing timeframe for rejected petitioners begins the date they file and are denied. In order for the state of Oregon to consider a Measure 37 claim, the claimant must first file with a local agency and be rejected, Gordon said. |
